This position fills the critical role of providing timely, insightful and pragmatic counseling on compliance with federal and state food law requirements as well as coordinator for regulatory compliance advice on global initiatives having regulatory consequences. This position will report to the Senior Director, Regulatory Law and acquire responsibilities and assignments commensurate with proven abilities. Areas of counseling include labeling and claims requirements (including product naming implications and claims substantiation), regulatory requirements for ingredients and products, on-going compliance of products and marketing with existing and new regulations, interpretation of legislative or regulatory proposals that change existing requirements, and support for litigation over labels and claims. The role impacts new product developments and many marketing initiatives, especially those making nutrition claims. As an expert in the field, this role lends counsel and support to R&D Product Developers, R&D Regulatory, Nutrition Sciences, Scientific Affairs, Public Policy & Government Affairs, and Legal Marketing and Litigation Counsels. The Regulatory Law Counsel is expected to closely collaborate with Marketing counsels as well as the counsels for M&A, Procurement, Trademarks, and IP/R&D counsels.
Responsibilities Include:
Ensures company compliance with federal and state regulatory requirements by providing timely, pragmatic and insightful daily counseling for R&D and other company associates to avoid label & claim challenges that could disrupt business.
Participate in trade association working groups to lead and influence the development of new regulatory, labeling and compliance requirements.
Develop legally sound solutions for business initiatives through participation in the PepsiCo Claims Council.
Subject matter expert that stays abreast of legislative and regulatory developments affecting food law and clearly conveys to interested/affected company associates how such developments will affect PepsiCo and its businesses.
Co-chair of the Regulatory Law Best Practices Group. This group shares timely information that enables PepsiCo Law Department colleagues to assimilate information and coalesce our positions globally.
Support to litigation team on interpretation and scope of laws and regulations. Contribute insights that are critical to our defenses and are nuanced and insightful relative to regulatory interpretation and compliance.
Position Requirements:
J.D. from an accredited law school and top academic credentials.
Minimum 5 years legal experience, preferably with food law experience in a government enforcement agency, at a top-tier law firm, or as in-house counsel.
Marketing and claims experience essential.
Knowledge of federal and state food law requirements as well as FDA and FSIS procedures.
Authoritative presence to interact with and effectively counsel product developers, marketers and R&D functional experts (SRA, Nutrition, etc.) on regulatory compliance matters.
Possess an open, collaborative style that inspires confidence and trust.
Demonstrated ability to manage multiple projects and adapt quickly to changing priorities.
Ability to work independently and proactively on a wide variety of tasks in a fast-paced environment with minimal supervision and to exercise excellent judgment under pressure.
Strong analytical, communication, and inter-personal skills to serve as both business and legal adviser.
Strong conflict resolution skills.
